Welcome to Smith Haulage. These Terms and Conditions govern your use of our bulk haulage and waste transportation services. By engaging our services, you (“the Client”) agree to be bound by these terms. Please read them carefully.
Definitions
“We/Us/Our”: Smith Haulage, operating from Hythe Farm, London.
“Client/You”: The individual, company, or entity booking our services.
“Services”: The bulk haulage, waste collection, and transportation services we provide.
“Waste Stream”: The specific type of waste material being transported (e.g., General Waste, Dry Mixed Recyclables, Plasterboard).

Quotations and Pricing
Quotations are valid for 30 days from the date of issue.
Prices are based on the information provided by the Client at the time of quotation. We reserve the right to adjust the price if the service requirements change, including but not limited to variations in volume, weight, type of waste, or site accessibility.
All prices are exclusive of VAT, which will be added at the prevailing rate.
Client Responsibilities and Warranties
The Client warrants and agrees that:
All waste materials presented for collection are as described in the service booking and are not hazardous, toxic, or otherwise prohibited by law.
They hold all necessary permits and consents for the waste to be collected from the specified location.
The waste is stored safely and is accessible for our vehicles and operatives at the agreed collection time.
They will ensure our drivers have safe and unobstructed access to the site. Any delays caused by the Client’s failure to provide access may incur additional waiting time charges.
Cancellation and Rescheduling
Cancellations must be made at least 24 hours prior to the scheduled collection time. Cancellations with less than 24 hours’ notice may be subject to a cancellation fee of up to 50% of the quoted price.
We will make every reasonable effort to accommodate rescheduling requests but cannot guarantee availability.
Liability and Indemnity
We will carry out our services with reasonable skill and care. Our total liability to the Client for any loss or damage shall not exceed the value of the service provided.
We are not liable for any indirect or consequential loss, including loss of profit or business opportunity.
The Client agrees to indemnify us against all claims, liabilities, costs, and expenses arising from a breach of the Client’s warranties in clause 4, including the misdescription of waste or the presence of hazardous materials.
Waste Transfer Notes and Compliance
We are an upper-tier registered waste carrier. A Waste Transfer Note (WTN) will be provided for all collections, as required by law.
It is the Client’s responsibility to ensure the WTN is accurate and retained for their records for a minimum of two years.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to adverse weather conditions, traffic accidents, mechanical breakdown, industrial action, or changes in legislation.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Amendments
We reserve the right to amend these Terms and Conditions at any time. The latest version will always be available on our website. Continued use of our services constitutes acceptance of the updated terms.
